In their alert, the MRF insist that the Sofia City Prosecutor investigate Minister Demerdzhiev in relation to performing activities without the supervision of the Prosecutor and despite the SCP demanding the files on this investigation, probably using "dual checks" for this purpose.
It also adds that Demerdzhiev in his media declarations in the USA has admitted and confirmed that the MoI is continuing illegally to investigate a Member of Parliament protected by immunity – such as the Chairman of the MRF, Mr.Delyan Peevski. Moreover, the MoI is continuing to collect and process information relating to Delyan Peevski and third persons, as well as to use the resources of the security services, including the General Directorate for Combating Organised Crime, the State Agency for National Security, and the National Unit for Receiving and Processing Booking Data on Air Travellers. The notification also refers to unregulated access to data from the PNR system, which probably is damaging to the Bulgaria's partner services and to foreign states.
The alert also indicates that it is absolutely inadmissible for the information illegally gathered by the MoI to be presented to representatives of another country; not in the established order, but during a regular meeting between Demerdzhiev and administrative staff, especially given that this information concerns a person protected by immunity.
It should also be considered that the global Magnitsky sanctions are not active within the territory of the European Union, in particular the Republic of Bulgaria. This is set out in the provisions of Regulation (EC)2271/96 of the Council protecting against the effects of the extra-territorial application of legislation adopted by a third country, and actions based thereon or resulting therefrom. The meaning of this provision is that the member states of the European Union, of which Bulgaria is one, are obliged not to comply with legislation with extra-territorial application. Therefore, it is absolutely inadmissible for an official such as a minister to demand that representatives of a third country impose sanctions on a Bulgaria citizen, and for this third country to undertake any additional injurious actions towards such a person.
